None appears for the petitioner at the time of call. Herd Mr. S.N. Nayak, learned Additional Standing Counsel for the State. Perused the record. 3.

The petitioner has filed this writ petition seeking direction to the opposite parties to refrain from demolishing the outhouse of the petitioner situated in Mouza-Bhubaneswar Town, Unit No. 39, Gadakana, Stitiban Khata 588, Plot no. 4748, Area Ac. 0.540 dec. now Hal Khata No. 4689, Plot No. 8182 within the Bhubaneswar Municipal Corporation and not to interfere with the possession of the petitioner over the land without due process of law. 4.

In apprehension of eviction, the petitioner has approached this Court in the present writ petition, since no notice of eviction has been incorporated in the writ petition.

Therefore, the writ petition is a premature one, which is accordingly dismissed.
