BLAPL No.6479 of 2022 Bamura @ Bambura Sukamajhi ....

Petitioner Mr.M. Das, Advocate -versusState of Odisha ....

Opposite Party Mr.Samaresh Jena, ASC

CORAM:

MR. JUSTICE D.DASH

ORDER

12.12.2022 Order No.

02.

1.

This matter is taken up through hybrid arrangement (virtual/physical mode).

2.

This is the second journey of the petitioner, who is in custody in connection with S.T. Case No.107 of 2021 arising out of Tumudibandha P.S. Case No.27 of 2021 pending in the Court of the learned Additional Sessions Judge, Balliguda for offence punishable under sections 450/302/506, I.P.C. in filing this application under section 439, Cr.P.C. for his release on bail. 3.

Heard learned counsel for the Petitioner and learned counsel for the State.

4.

Considering the submissions made and on going through the materials on record as also the surrounding circumstances; while being not inclined to reconsider for grant of bail to the Petitioner; this application is disposed of granting liberty to the Petitioner to renew his prayer for grant of bail before the Trial Court after examination of the Informant-Pramita Pattamajhi.

// 2 // 5.

It is needless to say that the Trial Court would do well to take all such effective steps as provided in law for early examination of the Informant so as to enable the Petitioner to exercise the liberty as afore-granted.

6.

The BLAPL is accordingly dismissed.

7.

Issue urgent certified copy as per rules.
