Heard Mr. S. Sahoo, learned counsel for the petitioner and Mr. D.K. Mohanty, learned Additional Standing Counsel. 2.

At the outset, Mr. Sahoo is permitted to attest Annexure-1 in Court today.

According to Mr. Sahoo, the grievance of the petitioner in this case pertains to non-disposal of I.C.C. Case No.307 of 2021 pending before the learned J.M.F.C., Cuttack involving Section 138 of the Negotiable Instruments Act, 1881. He further submits that though as per Section 143(3), Cr.P.C., the trial should have been concluded within six months from the date of filing of the complaint, however, notwithstanding, appearance of opposite party no.2 the accused in the proceeding below since 28.7.2021, the case is still pending. In such background, he prays that a direction be issued to the learned J.M.F.C., Cuttack to conclude the trial within a stipulated time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court

// 2 // directs the learned J.M.F.C., Cuttack to make all endeavour to conclude the trial in the above noted case in accordance with law within a period of six months from the date of receipt of a certified copy of this order, if there is no other impediment. 4.

The CRLMP is accordingly disposed of.

Issue urgent certified copy of this order on proper application.
