Heard learned counsel appearing for the parties. 2.
Considering petitioner has already lost in his attempt through the encroachment proceeding, this Court finds there is no possibility to consider the settlement aspect involving the petitioner in exercise of provision under O.P.L.E. Act. It is at this stage of the matter, learned counsel appearing for the petitioner seeks withdrawal of the writ petition with liberty to the petitioner to pursue other remedies available. Consequently, the writ petition stands dismissed as withdrawn but however with liberty, as prayed for.
