Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 01.08.2021 in connection with Kodala P.S. Case No.370 of 2021 corresponding to S.T. Case No.09 of 2022 pending in the Court of learned Addl. District and Sessions Judge, Kodala, Ganjam for the alleged commission of offence under Sections 450/323/376/506 of IPC.

The petitioner was granted interim bail for a period of six weeks by order dated 04.10.2022 considering his submission that he and the victim had decided to marry. He was released on interim bail. The petitioner and the victim got married on 11.11.2022. A marriage certificate issued by the office of the Panchayat Samiti, Beguniapada, Ganjam was produced for perusal of the Court. Learned State Counsel has obtained instructions that on local enquiry it was ascertained that the petitioner and the victim have in fact been married and that the marriage certificate produced before this Court is genuine.

Considering the above facts and taking into account the fact that the petitioner and the victim have already married, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose. 6.
BLAPL is accordingly disposed of.
