Heard learned counsel for the petitioner and learned counsel for the State.

The Petitioner is an accused in connection with G.R. Case No. 147 of 2022 arising out of Bandhugaon P.S. Case No. 47 of 2022 pending on the file of learned J.M.F.C., Laxmipur, Koraput registered for the alleged commission of offence under Sections-376(2)(n)/506 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Additional Sessions Judgecum-Special Judge, Koraput by order dated 04.07.2022 in BLAPL No. 138 of 2022, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim, considering the same, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter, including the additional condition that the petitioner shall not in any way intimidate either victim or her family members and she shall appear before the Investigating Officer once every week till submission of the Final Form.

Accordingly, the BLAPL stands disposed of.
