Heard learned counsel for the Parties.

The Writ Petition involves a challenge to the order at Annexure-2. Considering the submission of learned counsel for the Petitioner, this Court finds, the impugned order at Annexure-2 is interfered under the provision of the OPLE Act. 3.

In the circumstance, this Court finds, the Writ Petition is not entertainable. Consequently, the Writ Petition stands dismissed on technical ground. Dismissal of the Writ Petition shall not stand on the way of the Petitioner in approaching the Appellate Authority under appropriate law.

This Court observes since Appeal time involving Annxure-2 is not expired , there is no requirement of interim protection at least till expiry of the thirty days period from the date of notice. (Biswanath Rath) Judge Swarna
