This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.32 of 2022, pending in the file of learned Presiding Officer, Special Court under POCSO Act, Mayurbhanj, Baripada, arising out of Rairangpur Town P.S. Case No.63 of 2022, offence under Sections 509/363/366/376(2)(n) of IPC and Section of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Presiding Officer, Special Court under POCSO Act, Mayurbhanj, Baripada by order dated 10.06.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim and the medical examination report being filed by the learned counsel for the petitioner.

Taking into account the submission of the learned counsel for the petitioner and considering that the petitioner is in custody since 08.04.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
