This matter is taken up through hybrid arrangement Order No.

(virtual/physical mode).

The petitioner being in custody in connection with P.R. No.160/2017-2018 corresponding to 2(a) C.C. Case No.03/2018(N) pending in the court of the learned Special Judge-cum-2nd Additional Sessions Judge, Ganjam, Berhampur running for the alleged commission of offence under sections 20(b)(ii)(C) of the N.D.P.S. Act has filed this application under section 439, Cr.P.C. for his release on bail. 3.

Heard learned counsel for the petitioner and learned counsel for the State.

Taking into account the submissions made and on going through the materials on records as those stand against the Petitioner as also the quantity of contraband ganja said to have

// 2 // been seized; further keeping in view the surrounding circumstances including the period of detention of the Petitioner in custody after apprehension; it is directed that the petitioner be released on bail in the aforesaid case with such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that:- (i) he will appear in person on each date of posting of the case before the court in seisin of the case till conclusion of trial;

(ii) will report before the Investigating Officer, EI & EB (SD), Berhampur on every Monday in between 10 A.M. to 2 P.M. for a period of one year; and (iii) will not indulge himself in commission of similar activity.

Violation of any of the above condition(s) shall entail cancellation of bail.

The BLAPL is accordingly disposed of.
