Heard learned counsel for the Parties.

Petitioner alleges that the complaint is required to be considered in exercise of power under the provision of Section 26 of the Orissa Grama Panchayat Act and the Collector-cum-District Magistrate, Jajpur-Opposite Party No.2 is declined even to accept the complaint at the instance of the Petitioner.

Learned State Counsel submits that, in the event, there is declining of acceptance of application by the Competent Authority, nothing prevented the Petitioner to send the dispute through Registered Post/ Speed Post with A.D. Without entering into such controversy since this Court finds, the Petitioner has a right to demand for exercise of power under Section 26 of the Orissa Grama Panchayat Act. 4.

In the event, the Petitioner re-submit such Petition at least within a period of seven working days hence, the same shall be
