This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned Addl. Govt. Advocate for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail, involving offences punishable under Sections 279/336/294/353/332/34, I.P.C. Perused the copy of the F.I.R.

Considering the seriousness and gravity of the offence as alleged and the facts of the case, although this Court is not inclined to grant anticipatory bail to the Petitioner, however it is observed that, in the event the Petitioner surrenders before the learned J.M.F.C., Basta in C.T. Case No.454 of 2022 corresponding to Basta P.S. Case No.172 of 2022 within a period of three weeks from today, the Petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper in the facts and
// 2 // circumstances of the case. While imposing conditions, learned Magistrate shall also impose conditions that the Petitioner shall not indulge in any criminal activities as has been alleged against him. Further, if it is found that the Petitioner is involved in such activities while on bail, this bail order shall stand revoked forthwith. 5.
The ABLAPL is disposed of accordingly.
