This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and learned Addl. Govt. Advocate for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail, involving offences punishable under Sections 420/34, I.P.C.

It is stated by learned counsel for the Petitioners that Plot No.1868 in respect of which the present case has been registered against the Petitioners for non-registration of Sale Deed and for mutation of land in favour of the Informant has already been solved and the land has already been mutated in the name of the Informant. In the aforesaid premises, learned counsel for the Petitioners draws attention of the Court to the R.O.R. under Annexure-2 attached to this Bail Application.

Considering the aforesaid submissions, nature of allegation, gravity of the offence and the facts of the case, although I am not inclined to grant anticipatory bail to the Petitioners, however it is observed that, in the event the Petitioners surrender before the learned J.M.F.C.,(O), Bhubaneswar in G.R. Case No.129 of 2020 corresponding to Nandankanan P.S. Case No.12 of 2020 within a period of three weeks from today, the Petitioners shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper in the facts and circumstances of the case. 6.

The ABLAPL is disposed of accordingly.
