This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners as well as learned Addl. Govt. Advocate for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail, involving offence punishable under Sections 341/323/294/325/354/506/34, I.P.C.

Considering the gravity of the offence as alleged and the facts of the case, although this Court is not inclined to grant anticipatory bail to the Petitioners, however it is observed that, in the event the Petitioners surrender before the learned J.M.F.C. (R), Cuttack in G.R. Case No.1579 of 2022 corresponding to Choudwar P.S. Case No.309 of 2022 within a period of three weeks from today, the Petitioners shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper in the facts and

// 2 // circumstances of the case, subject to further condition that the Petitioner, while on bail, shall not threaten, terrorise or harass the informant and his family members in any manner whatsoever. Violation of any of the conditions shall entail cancellation of bail. 6.

The ABLAPL is disposed of accordingly.
