Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 09.10.2020 in connection with C.T. Case No. 5 of 2021 corresponding to G.R. Case No. 250 of 2020 pending in the court of learned Addl. Sessions Judge, Kamakshayanagar for the alleged commission of offence under Section 302 of IPC.

It is alleged that the petitioner, who is the wife of the deceased assaulted him by means of lamp glass and also pressed his scrotom due to which he died. It is submitted that the petitioner was heavily intoxicated at the relevant time and the possibility of the injuries having been sustained due to fall on the broken glass cannot be ruled out.

Considering the submissions as above, the materials on record,

the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that she shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
