This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and the learned counsel for the State.

The Petitioner is an accused in G.R Case No.410 of 2022 pending on the file of learned J.M.F.C., Salipur, arising out of Nischintakoili P.S. Case No.77 of 2022 for commission of offence under Sections 376/506 IIPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Salipur by order dated 27.06.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the Petitioner submits that the Petitioner does not want to press this bail application but seeks liberty to renew his prayer after examination of the victim.

In view of such submission, this BLAPL stands disposed of as not pressed.

Since it is stated that the Petitioner is in custody since 26.05.2022, learned Court in seisin over the matter is called upon to expedite the trial of the aforesaid case and conclude the same within the period of three months from the date of receipt/production of the copy of this order.

In the event the trial is not concluded within the time stipulated, it shall be open to the Petitioner to renew his prayer before the learned Court in seisin over the matter, which shall be considered on its own merit without being influenced by the earlier rejection or the order passed by this Court.

9.

Registry is requested to communicate this order to the learned Court in seisin over the matter.

Urgent certified copy of this order be granted as per rule. (V. NARASINGH) Judge PKS
