Heard learned counsel for the Parties.

This matter involves shifting of an OMFED Booth in the particular area involved. This matter was heard and while directing not to disturb the Petitioner, notice was issued and extra copy of the Brief was served on Mr.D.Nayak, learned counsel for the Cuttack Municipal Corporation, O.P.2. Today Mr.Nayak, learned counsel for the Corporation files an affidavit in Court disclosing therein that the Cuttack Municipal Corporation is not interested in shifting the OMFED Booth in possession of the Petitioner.

Recording the statement of the learned counsel for O.P.2 and as the statement also being confirmed through the affidavit, particularly in Paragraph-7 therein, this Court finds, the grievance of

As a consequence, this Court drops the Writ Petition with recording of the undertaking of the Cuttack Municipal Corporation, which is not interested in shifting the Petitioner's Kiosk.
