Heard learned counsel for the Parties.

This Writ Petition was earlier filed through Mr.B.C.Panda, learned Advocate as Counsel for the Petitioners. Argument advanced on the hearing of the matter on all occasions that there has been action of eviction by the Public Authority without following due process of law, which submissions appearing to be doubtful. The matter was adjourned to today with direction to the Petitioners to serve copy on the respective Counsel for O.Ps. 3.

Now filing an affidavit of the Development Authority, Mr.D.Mohapatra, learned counsel brought to the notice of the Court that there are series of litigations involving the Petitioners, even one Writ Petition already by the Petitioners pending. It is alleged, the

// 2 // Writ Petition involves serious suppression of material facts. Today the Petitioners have a different Counsel to place their case. 4.

At this stage of the matter, Mr.B.Baug, learned counsel appearing for the Petitioners seeks withdrawal of the Writ Petition admitting that there has been suppression of material facts but claiming to be bona fide and unintentional.

The Writ Petition thus stands dismissed as withdrawn. The affidavit filed by O.P.4 be kept on Record.
