1. Although Mr. Janmejaya Katikia, learned Additional Government Advocate cites two earlier cases of 2009 in which the Petitioner was involved for less serious offences, the fact remains that the present Applicant/Petitioner, Sk. Anu@ Anwar has been continuously in custody in the present case for over ten years now. It is unlikely that the present appeal will, in its turn, be heard at an early date.
2. Consequently, following the dictum of the Supreme Court of India in Surinder Singh @ Shingara Singh v. State of Punjab, (2005) 32 OCR (SC) 430, the Court considers it appropriate to direct that the Applicant/Petitioner shall be released on bail subject to the satisfaction of the Trial Court during the pendency of this appeal. Among the conditions to be incorporated by the Trial Court one will be requiring the Petitioner/Applicant to appear before the SHO of the local Police Station at least once in a fortnight.
3. The application is disposed of.
