Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.791 of 2021 arising out of Nischantakoili P.S. Case No. 147 of 2022 on the file of learned JMFC, Salipur registered for the alleged commission of offence under Sections 379/411/34 of the I.P.C. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. District & Sessions Judge, Salipur by order dated 22.06.2022in BLAPL No. 83 of 2022, the present BLAPL has been filed.

Learned counsel for the petitioner submits that petitioner has been remanded in this case because of his antecedent and prays that since the Charge-sheet has already been filed and co-accused similarly circumstanced has already been released on bail by this Court by order

dated 9.05.2022 in BLAPL No.3188 of 2022, his further continuance is unwarranted.

Learned counsel for the State submits that taking into account the nature of the criminal antecedents of the petitioner, as noted in the rejection order, he is not entitled to be released on bail. 7.

Considering the period of custody since 11.01.2022, release of the co-accused and filing of Charge-sheet, this Court directs that the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Additionally, it is directed that the petitioner shall appear before the jurisdictional Police Station twice in every week till conclusion of trial. The first two dates and time of appearance to be fixed by the learned court below. Certificate of such appearance to be submitted to the learned court in seisin over the matter. It is needless to say that any violation shall entail cancellation of bail without any further reference to this Court.

Accordingly, the BLAPL stands disposed of.
