Heard Mr. P.K. Mishra, learned Counsel appearing for the Petitioner and Mr. P.P. Mohanty, learned Addl. Government Advocate for the State.

In compliance of the Orders dated 14.07.2022 and 20.07.2022, the Opposite Parties have filed Counter Affidavit, Paragraph-12 whereof read as under:

" That on 14.07.2022 and 22.07.2022, this Hon'ble Court has directed the State Counsel to take instruction with regard to willingness to the Petitioner to deposit the amount in question for which lease has been cancelled by this deponent. This deponent has no objection with regard to payment of Petitioner, otherwise the State has been suffering heavy financial loss due to non-operational of sand quarry."

In view of above statement made in the Counter Affidavit, the Petitioner is permitted to deposit the amount before the Authority, as expeditiously as possible, preferably within a period of 15 days, so that follow up action can be taken up by the Authority in accordance with Rules.

According, the Writ Petition is disposed of.

Issue urgent certified copy of this order.
