Heard Mr. K.C. Kar, learned counsel for the petitioner. 3.

This application under Section 24 of the C.P.C. has been filed by the petitioner-wife praying for transfer of Civil Proceeding No.162 of 2021 filed by the opposite party-husband under Section 12 of the Hindu Marriage Act, in the Court of the learned Judge, Family Court, Jajpur, to the Court of the learned Judge, Family Court, Cuttack.

Mr. Kar, learned counsel for the petitioner -wife submits that the earlier TRP(C) No.380 of 2021 had been filed with the same prayer but the same was withdrawn with liberty to file a better application and pursuant to the said order, this application has been filed. He further submits that the marriage between the parties was solemnized on 01.07.2020 and the petitioner is residing in Cuttack and the distance between Jajpur and Cuttack is 70 kms., for which the petitioner is facing difficulty in going to Jajpur alone, as she is not getting proper cooperation from her parents. He also submits that the petitioner has appeared

through advocate in the case on 10.11.2021 and taken time for filing written statement and now the case is fixed to 24.08.2022. 5.

After hearing the learned counsel for the petitioner and perusing the TRP(C) petition, I am not satisfied that a case is made out for transfer from the Court of the learned Judge, Family Court, Jajpur to the Court of the learned Judge, Family Court, Cuttack.

The TRP(C) is accordingly dismissed.
