Heard learned counsel for the parties. The ground raised herein is Order No.
very much available to be agitated before the Appellate Court and can be adjudicated by the Appellate Court. In the circumstance for the petitioner having clear remedy of appeal, the writ petition is not entertainable at this stage. In the event the petitioner files an appeal at least within a period of ten days hence along with an application for condonation of delay, the same shall be considered and the appeal will be heard and disposed of on its own merit.

The writ petition stands disposed of with the observation and direction made hereinabove.
