This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioners are accused in connection with O.R. Case No.2 NW of 2022-23 corresponding to 2(b) C.C. Case No. 2 of 2022 pending on the file of learned JMFC, Narasinghpur, registered for the alleged commission of offence under Sections 51 of the Wild Life Protection Act.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge, Athagarh by order dated 5.07.2022 in BLAPL No. 203 of 2022, the present BLAPL has been filed.

Taking into account the nature of allegation, this Court directs that the petitioners to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 6.
While releasing, the learned court in seisin over the matter will direct that the petitioners shall appear before the Investigating Officer once every week till conclusion of the investigation. Certificate of such appearance shall be submitted to the learned court in seisin over the matter. Violation of such appearance shall entail cancellation of bail 7.
Accordingly, the BLAPL stands disposed of.
