This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.633 of 2021, pending in the file of learned JMFC, Rajgangpur arising out of Bargaon P.S. Case No.166 of 2021, offence under Sections 370/323/384/506/34 of IPC and is in custody since 07.06.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumspecial Judge, Vigilance, Sunargarh by order dated 30.06.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Taking into account the specific observations of the learned Court while considering the bail application that the sole allegation against the petitioner was that the petitioner did not pay

the dues of the victim and considering the nature of allegations and since the petitioner is in custody since 07.06.2022 and there has been substantial progress in the investigation, this Court direct the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
