This matter is taken up through hybrid mode.

Heard Mr. B. Routray, learned Senior Advocate along with Mr. S.D. Routray, learned Counsel for the Petitioner and Mr. S. Rath, learned Additional Standing Counsel for the State. 3.
The Petitioner has filed this Writ Petition seeking direction to Opposite Party No.3 to declare the Petitioner as qualified in the Technical Bid pursuant to the Tender under Annexure-1 keeping in view the similar nature of work completed by the Petitioner. 4.
In course of hearing, learned Counsel for the Petitioner states that highlighting the grievance, the Petitioner has already made a representation before the Opposite Party No.3-Chief Construction Engineer, Rural Works Circle, Kendrapara on 08.07.2022 under Annexure-5, and the same may be directed to be disposed of within a stipulated time, to which, learned Counsel for
the State has no objection.

As agreed to by learned Counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of this Writ Petition directing Opposite Party No.3 to consider the representation filed by the Petitioner vide Annexure-5 and pass appropriate order in accordance with law within a period of four weeks from the date of production of certified copy this order. 6.
Issue urgent certified copy as per rules.
