This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Parties.

3. The Petitioner is aggrieved by the initiation of the proceeding under Section-7-A of the EPF & MP Act, 1952 under Annexure-1.

It is submitted that initiation of the said proceeding under Section-7-A of the EPF & MP Act is not permissible. Even though a reply under Annexure-4 to the said notice has been filed on 18.05.2022 but the petitioner has not raised such a point for consideration by the said authority.

In view of that, this Writ Petition is disposed of permitting the Petitioner to file a fresh reply within a period of ten days from today. It is observed that if such

// 2 // a fresh reply is filed within the aforesaid time period, the Opposite Party No.1 shall take a lawful decision on the same by giving personal hearing to the petitioner within a further period of two weeks. Till such a decision is taken, no coercive action shall be taken against the Petitioner.
