None appears for the petitioner when the matter is called. 3.

The petitioner is an accused in connection with C.T. Case No. 142 of 2022 arising out of Talsari Marine P.S. Case No. 19 of 2022, pending on the file of the learned Nyayalaya-cum-J.M.F.C., Bhograi for the alleged commission of offence under Sections498-A/302/304-B/34 of the I.P.C read with Section-4 of the D.P.Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge, Balasore by Order dtd. 02.07.2022 in Bail Application No. 52 of 2022, the present BLAPL has been filed.

On perusal of the order of rejection dtd. 02.07.2022, it is seen that the learned Court below has specifically stated that " The investigation is still under way. "

Taking note of the same, this Court is not inclined to entertain this application at this stage. Leave is granted to move after filing of Charge-sheet. It shall be considered by the learned Court in seisin over the matter on its own merit without being influenced by the earlier order of rejection or the present order passed by this Court.

The Bail Application thus stands disposed of. 8.
