This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in C.T. Case No.1312 of 2022 pending in the file of learned S.D.J.M. Kendrapara, , arising out of Nikirei P.S. Case No.96 of 2022, offence under Sections 447/323/307/379/387/509/506/34 of IPC.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kendrapara by order dated 11.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioners submits that the injury report has categorized that injuries are simple in nature. It is further submitted that so far as antecedents as noticed in the rejection order are all inter se between the parties.

Learned counsel for the State opposes the prayer for bail on the ground that because of the antecedents the present petitioners ought not to be released on bail at this stage even though charge sheet has been filed.

Taking into account that the petitioners are in custody since 25.06.2022 and inter se previous enmity, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Considering their criminal proclivity it is directed that petitioners shall appear before the jurisdictional police station once every 15 days till the conclusion of trial.

Accordingly, the BLAPL stands disposed of.
