This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special G.R. Case No.07 of 2017, on the files of District and Sessions Judge, Balangir, arising out of Balangir Town P.S. Case No.16 of 2017, under Sections 20(b)(ii)(c) and 29 of the NDPS Act.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional District Judge at Balangir, by order dated 31.03.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the report submitted by the first additional Sessions Judge Balangir regarding the stage of trial. 6.
Learned counsel for the petitioner that the co-accused similarly circumstanced have since been released on bail by this
Court in order dated 14.09.2017 in BLAPL No.3530 of 2017 and dated 31.10.2017 in BLAPL No.3634 of 2017 and dated 12.07.2018 in BLAPL No.1009 of 2018.

Considering the submissions of the learned counsel for the petitioner and release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner shall appear before the jurisdictional Police Station once every 15 days till the conclusion of the trial. Violation of any of the condition shall entail the cancelation of the bail.

Accordingly, the BLAPL stands disposed of.
