Heard Mr. B.B. Mishra, learned counsel for the petitioners and Mr. D.K. Mohanty, learned Additional Standing Counsel.

According to Mr. Mishra, the grievance of the petitioners in this case pertain to non-awarding of compensation in their favour despite acquisition of Plot No. 121 pertaining to Khata No. 202 measuring an area Ac.0.230 dec. out of total land of Ac.4.602 dec. of Kissam-Gharabari falling under Mouza-Sohela in the District of Subarnapur belonging to them. Instead paying them compensation, according to Mr. Mishra, the payment has been made to one Mr. Patuwari Padhan (Opposite Party No.5) who is not entitled to get the same. He further submits that though the petitioners had approached the Collector-cum-District Magistrate, Subarnapur (Opposite Party No.2) by highlighting their grievances that though the same was received by the said Opposite Party on 28.04.2017, however till date nothing

Mr. Mohanty, learned Additional Standing Counsel in this connection draws our attention to 2nd Proviso to SubSection 1 of Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and submits that instead of approaching this Court, the petitioners should have approached the Land Acquisition, Rehabilitation and Resettlement Authority for redressal their grievances. 4.

Considering such submission, Mr. Mishra wants to withdraw this writ petition as the petitioners want to approach the above noted authority for redressal of their grievances.

Considering the submissions made, the writ petition is disposed of as withdrawn.
