This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in 2(a) C.C. No. 13 of 2022 arising out of OIC of Excise, Baliguda P.R. No. 35 of 2022-23 pending on the file of learned Special Judge, Baliguda, under Sections 20(b)(ii)(B) of N.D.P.S. Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge-cum-ADJ, Baliguda, by order dated 8.07.2022, the present BLAPL has been filed. The petitioner is stated to be in custody since 8.07.2022. 5.
Perused the order of rejection.

Considering the quantity of contraband seized to the tune of 10 Kgs contraband (Ganja), which is admittedly less than commercial quantity and the period of custody, this Court directs
the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner shall appear before the jurisdictional Police Station once in every week till submission of the Final P.R. Violation of such appearance shall entail cancellation of bail.

Accordingly, the BLAPL stands disposed of.
