Heard learned counsel appearing for the petitioner. Order No.

This writ petition involves a challenge to the order at Annexure4. It appears, this is a second round of litigation. In the first round of litigation in disposal of W.P.(C).No.27808 of 2021. this Court by order dated 22.09.2024 directed the Collector & District Magistrate Kandhamal, Phulbani to look into the grievance of the petitioner, who claimed to be a student guardian. It is after the direction of this Court in disposal of the above writ petition, it appears, the Collector has undertaken the exercise and while rejecting the application of the petitioner has come to observe as follows:

"Keeping in view the guidelines regarding functioning of Minority managed schools circulated by the Govt. in S & ME Department, written submission by the petitioner as well as Opposite Party No.6, 7 & 8 and all relevant records related to the case the undersigned arrives at the conclusion that the representation filed by the petitioner has got no merit and is hereby rejected.

Further Opposite Party no.6 i.e. Managing Committee, Vijaya High School, Raikia is hereby advised to ensure utilization of all funds received out of the Shopping Complex towards welfare of the children studying in the school under "Mo School Programme" and separate account shall be mentioned which is subject to audit."

During course of submission, this Court also records the clear statement of learned counsel for the petitioner that the petitioner, who is moving here, has no child getting education in the institution involved. On the ground of locu standi of the petitioner further for the reason

// 2 // already assigned by the Collector and further keeping in view that nonconstruction of the School rather affects the educational atmosphere involving the students of the educational institution involved. Consequently, this Court is not inclined to entertains such writ petition which is dismissed accordingly.
