This is the successive journey of the Petitioner in filing this application under Section-438 of the Cr.P.C. for his grant of bail in the event of his arrest in connection with Nihalprasad P.S. Case No.117 of 2016 corresponding to G.R. Case No.1162 of 2016 on the file of learned J.M.F.C., Gondia, for alleged commission of offence under Section-147/148/341/294/323/353/307/379/149 of the IPC read with Section-18 of the OM&M(Prevention of Theft Smuggling) Act, for his release on bail in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made further keeping in view the earlier orders passed in ABLAPL No.18294 of 2016 and ABLAPL No.20477 of 2016, in the absence of any change in the circumstances; is hereby dismissed the present application. 5.

The ABLAPL is accordingly dismissed.
