This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties..

The Petitioner is an accused in connection with Daspalla P.S. Case No. 91 of 2021 corresponding to Special G.R.Case No. 76 of 2021pending on the file of learned Sessions Judge-cumSpecial Judge, Nayagarh, registered for the alleged commission of offence under Sections 20(b)(ii)(c)/29 of the NDPS Act. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Nayagarh by order dated 7.07.2021, the present BLAPL has been filed.

Learned counsel for the petitioner relying on the order passed by this Court dated 4.03.2022 in BLAPL No. 8188 of 2021

sought for release of the petitioner inter alia, on the ground of parity.

On going through the order of this Court and on consideration of the recital of the C.D. relied upon by the learned counsel for the State, this Court of the considered opinion that the petitioner is not similarly circumstanced with one Sk.Suleman, since released on bail.

Accordingly, in view of the bar contained under Sec. 37 of the NDPS Act, this Court is not inclined to entertain this bail application at this stage.

Accordingly, the BLAPL stands dismissed.
