This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction to the Divisional Forest Officer, Balasore Forest Division-Opposite Party No.2 to take a decision on its application dated 23rd October, 1989 under Annexure-7 for grant of Saw Pit license in its favour by giving opportunity of hearing and also to communicate the decision thereof to the Petitioner.

Considering the submission made by learned counsel for the Petitioner, this Court vide order dated 22nd July, 2022 directed learned State Counsel to take instruction as to whether the order dated 5th July, 2017 passed by this Court in OJC No.15451 of 1998 has been complied with or not. Mr. Dash, learned Additional Government Advocate, on instruction, submits that due to bifurcation of forest division, the matter could not be taken up, but steps are being taken up to comply with the said direction at an early date but not later than a period of one month. 4.

Ms. Sharma, learned counsel for the Petitioner does not have any objection to the same.

Taking into consideration the submissions made by learned counsel for the parties, this Court disposes of this writ petition with a direction to the Divisional Forest Officer, Balasore Division-Opposite Party No.2 to take a decision on the application submitted by the Petitioner under Annexure-7 in accordance with law as expeditiously as possible preferably by the end of November, 2022 and communicate the same to the Petitioner forthwith.

Urgent certified copy of this order be granted on proper application.
