This matter is taken up through Hybrid Mode.

Mr. J.Kamila, learned counsel prays an adjournment on the ground of personal difficulty of Sk.Zafrulla, learned counsel for the petitioner.

Keeping in view stage at which the order was passed by the learned Special Judge, Gunupur, this Court is not inclined to entertain prayer for adjournment.

Accordingly, the prayer for adjournment is rejected. 5.

Heard Mr. J.Kamila, learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with T.R. Case No. 66 of 2022 corresponding Gudari P.S. Case No. 41 of 2022, pending on the file of the learned Additional Sessions Judge-cum-Special Judge, Gunupur, for the alleged

commission of offence under Sections 20(b)(ii)(c)/25/29 of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judge-cum-Special Judge, Gunupur, by order dated 24.06.2022, the present BLAPL has been filed. 8.

On perusal of the order of rejection, it is seen the quantity of contraband involved is 180 Kgs. of Ganja. It is further seen that the consideration by the learned Special Judge was at the time of investigation.

This Court is not inclined to entertain this bail application at this stage.

Accordingly, the BLAPL is disposed of giving liberty to the petitioner to renew his prayer after filing of the Charge Sheet and the same shall be considered on its own merit without being influenced by the earlier order passed by the learned Special Judge or the order passed by this Court.
