This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. Case No. 523 of 2022 arising out of Balasore Town P.S. Case No. 130 of 2022, pending on the file of the learned SDJM, Balasore, for the alleged commission of offence under Sections 395/398 of the I.P.C. read with Section 27 of the Arms Act.

Being aggrieved by the rejection of his application for bail under Sec. 439 Cr.P.C. by the learned Sessions Judge, Balasore, by order dated 11.07.2022, in Bail Application No.682 of 2022, the present BLAPL has been filed.

The consideration by the learned Court in seisin over the matter was during the course of investigation.

The petitioner is at liberty to move the learned Court below after filing of Charge-Sheet. The same shall be considered on its own merit without being influenced by the earlier rejection or the order passed by this Court.

The Bail Application thus, stands disposed of. 8.

Urgent certified copy of this order be granted as per rules.
