This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1600 of 2022, pending in the file of learned S.D.J.M. Jharsuguda, arising out of Lakhanpur P.S. Case No.139 of 2022, offence under Sections 394 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Jharsuguda by order dated 04.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.06.2022. The charge sheet have been filed on 20.07.2022 his further continuance in the present case,

keeping in view the nature of allegation and punishment prescribed is unwarranted.

Learned counsel for the State opposes the prayer for bail inter alia on the ground that the petitioner has criminal antecedents including allegation of committing an offence under Section 307 of IPC.

Taking into account the filing of charge sheet and period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the jurisdictional police station once every week till the end of month November. The first date and time of such appearance to be fixed by the Court in seisin over the matter and thereafter once every month till the conclusion of trial.

Accordingly, the BLAPL stands disposed of.
