CORAM:

JUSTICE BISWAJIT MOHANTY JUSTICE SAVITRI RATHO

ORDER

28.07.2022 Order No.

01.

1. Heard Mr.T.K.Mahanta, learned counsel for the petitioners and Mr. D.K.Mohanty, learned Addl. Standing Counsel.

2. In this writ petition, the petitioners have prayed for a direction to the opp. party No.3, Special Land Acquisition Officer, Keonjhar to disburse their shares of compensation out of the awarded amount of Rs.13,01,432/- in Land Acquisition Case No.20 of 2016.

3. Mr. D.K.Mohanty, learned Addl. Standing Counsel submits that such a request for apportionment has already been rejected by the same opp. party vide Annexure-3 as he has no jurisdiction to decide the dispute relating to apportionment and he has also advised the parties including the petitioners to take shelter in proper forum. In this context, he draws our attention to Section 64 and Section 103 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

4. In such background, Mr.Mahanta, learned counsel for the petitioners wants to withdraw the writ petition as he wants to approach the appropriate authority for redressal of the grievances of the petitioners.

5. Considering such submission, the writ petition is disposed of, as withdrawn.

6. Urgent certified copy of this order be granted as per rules. Bichi (Biswajit Mohanty) Judge (Savitri Ratho) Judge
