This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1447 of 2022, pending in the file of learned S.D.J.M., Jharsuguda, arising out of Brajarajnagar P.S. Case No. 180 of 2022, for alleged commission of offence under Sections 341/294/506/307/323/325/34 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jharsuguda by order dated 07.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner relying on the orders passed in respect of the co-accused by order dated 02.08.2022 in BLAPL No.6775 of 2022 and by order dated 17.08.2022 in BLAPL No.7142 of 2022, that since the petitioner is similarly circumstanced, he may be released on bail.

Learned counsel for the State opposes the prayer for bail perused the order of rejection. In the said order of rejection, it is clear that the petitioner has eleven cases including one under Section 302 of IPC.

As such, ex-facie the petitioner is not similarly circumstanced with the co-accused, this Court is not inclined to entertain this bail application at this stage. The same stands rejected accordingly.

It shall be open to the petitioner to renew his prayer before the learned Court in seisin over the matter at a later stage. 9.
