This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with C.T. Case No. 1309 of 2022 arising out of Jharsuguda Sadar P.S. Case No. 106 of 2022, pending on the file of the learned SDJM, Jharsuguda, for the alleged commission of offence under Sections 457/380 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judge, Jharsuguda, by Order dtd. 27.06.2022 in Bail Application No.222 of 2022, the present BLAPL has been filed.

Perused the order of rejection.

Taking note of submission of the learned counsel for the petitioner that other co-accused has already been released on bail by the learned court in seisin over the matter and that the

petitioner is similarly circumstanced and has no criminal proclivity, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

While so releasing by the learned court in seisin over the matter to check the veracity of the submission of the learned counsel for the petitioner regarding the criminal proclivity. If it comes to the fore that the petitioner has any criminal proclivity, the present order shall stand recalled.

The BLAPL thus stands disposed of.
