Heard Mr. A.C. Behera, learned counsel for the petitioner and Mr. A.P. Das, learned A.S.C.

The present writ petition has been filed with the following prayer.
To issue Rule NISI for calling upon the opp. parties particularly opp. party Nos.2 & 3 for show cause as to why the direction will not be issued for providing compassionate appointment under Rehabilitation assistance scheme to the petitioner. This Hon'ble Court may make its rule absolute if no show cause or insufficient show cause is filed by the said opp. parties and direct the opp. party Nos.2 & 3 in the writ of Mandamus to take appropriate step for providing compassionate appointment to the present petitioner under rehabilitation Assistance scheme within a stipulated time for the interest of justice and equity.

It is submitted that the case of the petitioner has been sent back to opp. party No.3 by the Collector, Malkangiri-Opp. Party No.2 vide his letter dated 21.6.2017 under Annexure-4. It is submitted that though in the meantime sufficient time has
// 2 // already been passed, but no decision has been taken by the said Opp. Party No.3 in considering the grievance of the petitioner as prayed for, under the provision of Rehabilitation Assistance Scheme.

In view of such limited nature of prayer, this Court while disposing the writ petition, directs opp. party No.3 to take a decision as forwarded by Opp. Party No.2 under Annexure-2 within a period of two months from the date of receipt of this order.
