Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with Special G.R.. Case No.95 of 2020 arising out of Purighat P.S. Case No. 194 of 2020 on the file of learned ADJ-cum-Special POCSO Court, Cuttack, registered for the alleged commission of offence under Sections 363/366/328/323/294/376(3)/376(2)(n)/344/109 of the I.P.C. read with Sections 6 & 7 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned ADJ-cum-Special POCSO Court, Cuttack by order dated 16.07.2021, the present BLAPL has been filed 5.

Learned counsel for the petitioner has placed on record the statement of the victim, who has been examined as P.W.2. 6.

Considering the tenor of the statement, prima facie indicating the complicity of the principal accused is Rahul Das, this Court directs

that the petitioner shall be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Copy of the deposition of P.W. 2 be kept on record. 08.

Accordingly, the BLAPL stands disposed of.
