This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in connection with G.R. Case No.13 of 2022, pending in the Court of learned Special Judge-cumAdditional Sessions Judge, Parlakhemundi, arising out of Rayagada P.S. Case No.34 of 2022, for offences under Sections 341/323/294/354/506/34 of IPC read with Section 3(1)(r)(s)(w)/3(2)(va) of S.C. & S.T. (PoA) Act. 4.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Special Judge-cum-Additional Sessions Judge, Parlakhemundi, Gajapati, by order dated 26.05.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the State that notice has been served on the informant/victim on 19.09.2022.

There is no appearance on behalf of the informant/victim at the time of call.

Perused the 164 Cr.P.C. statement of the victim aged about 24 years.

Considering the tenor thereof and keeping in view filing of charge-sheet and the period of custody since 23.04.2022, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 8.

Accordingly, the BLAPL stands disposed of.
