CORAM:

JUSTICE BISWANATH RATH Order No.

ORDER

27.07.2022 1.

1.

This writ petition involves the following prayer: "The petitioner therefore, prays that this Hon'ble court may be graciously pleased to admit the writ application and after hearing the counsel of the petitioner direct the Opp.Party-2 to issue mutated ROR in favour of petitioner as per R.M.C. No.306/21 (annexure-2) within a stipulated time.

And/or any necessary direction/order be passed which is just and proper.

And for this act of kindness the petitioner shall as in duty bound ever pray."

2.

Prayer appears to be based on a direction of a competent authority involving R.M.C.No.306/21. This Court expresses its anxiety in the action of the Tahasildar in not suo motu undertaking the exercise of correction of record-of-right even after communication of such order and compelling the parties to burden the High Court in considering such unnecessary aspects and giving suitable direction expressing its anxiety. However, considering the innocuous prayer, this Court disposes of the writ petition directing the Tahasildar, Jatni-opposite party no.2 to work out the direction in Annexure-2 by completing the entire exercise

// 2 // within a period of two months from the date of communication of certified copy of this order by the petitioner subject to however there is no impediment by way of stay of order at Annexure-2 by any forum. sks (Biswanath Rath) Judge
