Heard learned counsel for the parties.

The Petitioner is an accused in connection with C.T. Case No.225 of 2021 arising out of Nilagiri P.S. Case No. 152 of 2021 on the file of learned SDJM, Nilagiri, registered for the alleged commission of offence under Sections 120(B)/419/395 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned 3rd Additional Sessions Judge, Balasore by order dated 16.07.2021, the present BLAPL has been filed.

Taking into account the orders passed by this Court in respect of the co-accused persons, namely, Chanduru @ Chandrakanta Mohapatra, Sania @ Surendra Pradhan & another, Dhanu @ Sushanrta Barik and Nilu @ Pradeep Kumar Pradhan
who have been released on bail by order dated 03.08.2021 passed in BLAPL No.5655 of 2021, order dated 12.08.2021 passed in BLAPL No.5917 of 2021, order dated 25.08.2021 passed in BLAPL No.6582 of 2021 and order dated 15.09.2021 passed in BLAPL No.5278 of 2021 respectively and the submissions of the learned counsel for the petitioner that he is similarly circumstanced, this Court directs that the petitioner shall be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

While, enlarging the petitioner on bail, learned court below in sesin over the matter is called upon to verify the criminal proclivity, since it is stated that the petitioner has no antecedents. If such criminal proclivity comes to the fore, the present order granting bail will stand recalled automatically without any further reference to this Court.

Accordingly, the BLAPL stands disposed of.
