This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State (Vig.). 3.

The Petitioner is an accused in connection with Sambalppur Vigilance P.S. Case No.24 of 2022 corresponding to Vig. G.R. Case No. 12 of 2022 on the file of learned Special Judge, Vigilance, Bolangir, for the alleged commission of offence under Section 7 of the P.C. (Amendment).Act.

Being aggrieved by the rejection of her application for bail U/s 439 Cr.P.C. by the learned Special Judge, Vigilance, Bolangir by order dated 13.07.2022, the present BLAPL has been filed. 5.

Learned counsel for the petitioner submits that since the petitioner is in custody since 13.07.2022 and substantial progress of the investigation, her further continuance in custody is not warranted.

Mrs. Tripathy, learned counsel for the Vigilance department submits that since investigation is going on, releasing of the petitioner at this stage will affect the ongoing investigation. 7.

Considering that the petitioner is a lady and investigation has substantially progressed, this Court directs that the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter including that petitioner shall cooperate with the investigation and shall appear as and when required by the Investigating Agency.

It shall be open to the Investigating Agency to move this Court for cancellation of bail in the event the petitioner does not cooperate with the investigation.

Accordingly, the BLAPL stands disposed of.
