This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
Heard the learned counsel for the petitioners and learned Central Government Counsel for the opposite parties.
The petitioners have filed this contempt petition for non-compliance of the order dated 17.10.2022 passed by this Court in W.P.(C) No. 21510 of 2022 in which direction was given to the opposite parties 1 to 4 to circulate the resolution dated 19.06.2022 within two weeks from the date of passing of the order.
Learned Central Government Counsel appearing for the opposite parties submitted that the resolution dated 19.06.2022 has been circulated to all concerned of the
// 2 // East Coast Railway as per order dated 28.10.2022 under Annexure-7 and therefore, the order of this Court has been complied with.
Learned counsel for the petitioner submitted that prior to the issuance of the order dated 28.10.2022 under Annexure-7, another order dated 20.10.2022 under Annexure-6 was issued by the Deputy Chief Personnel Officer (Gaz) of the East Coast Railway relating to the list of office bearers of Adhoc Zonal Executive Committee of All India SC/ST Railway Employees Association, East Coast Railway with the approval of the competent authority and the tenure of the said Committee is for a period of four months from the date of issue, i.e. up to 13.02.2023. It is further submitted that this is in gross violation of the earlier order passed by this Court.
Since the order dated 17.10.2022 passed by this Court in W.P.(C) No. 21510 of 2022 has been complied with, the contempt petition is dropped. However, the petitioners are at liberty file a separate writ petition challenging the order in Annexure-6, if they are so advised.
