Heard learned counsel for the Parties.

This Court finds, undisputedly, the Encroachment Case No.160 of 2013 is still pending. Pleading and submission discloses in the pending encroachment case, there is also application by the Petitioner for settlement of the disputed land. Through the documents, it has been brought to the notice of the Court that there has been some communication of the Tahasildar to the Director involving pendency of encroachment case for pendency of above, the Writ Petition thus is not entertainable at this stage.

In disposal of the Writ Petition as not enteratinable at this stage, this Court observes in the event the Encroachment Case No.160 of 2013 is still pending consideration, the same may be disposed of in accordance with law providing opportunity to all concerned and also keeping in view any application at the instance of the Petitioner pending for consideration of the settlement of the land in favour of the

// 2 // Petitioner by completing the entire exercise within a period of three months from the date of communication of this order by the Petitioner. 4.

A free copy of this order be handed over to learned State Counsel.
