1. This matter is taken up through hybrid arrangement.

2. Heard.

3. In this Writ Petition, the petitioner challenges the action of the opposite parties more particularly the opposite party No.1-Principal Secretary, S.T and S.C. Development and Minorities and Backward Classes Welfare Department, Odisha, Bhubaneswar in not taking any step for regularization of his service with all consequential benefits as admissible to him.

4. Learned counsel for the petitioner submits that the petitioner has been working as Cook-cum-Attendant in Renga Ashram School, in the district of Koraput since 16.02.1989. Learned counsel for the petitioner further submits that some similarly placed persons of other

// 2 // schools have already been regularized, whereas though the petitioner has served 33 years of service he has not been regularized.

At this stage, learned counsel for the petitioner submits that the petitioner may be permitted to withdraw this Writ Petition with liberty to approach the appropriate authority i.e. the opposite party No.1-Principal Secretary, S.T and S.C. Development and Minorities and Backward Classes Welfare Department, Odisha, Bhubaneswar to seek his remedy by filing a representation.

6. In view of the above, this Writ Petition is disposed of giving liberty to the petitioner to file a representation before the opposite party No.1-Principal Secretary, S.T and S.C. Development and Minorities and Backward Classes Welfare Department, Odisha, Bhubaneswar along with a copy of this order and a copy of the Writ Petition. On such event, the opposite party No.1-Principal Secretary, S.T and S.C. Development and Minorities and Backward Classes Welfare Department, Odisha, Bhubaneswar shall consider the representation to be filed by the petitioner and dispose of the same in accordance with law by passing a reasoned order within a period of

// 3 // forty-five days from the date of submission of the representation.

7. Accordingly, this Writ Petition is disposed of.

8. Urgent certified copy of this order be granted on proper application.
